The above four minute video was recorded just prior to the Supreme Court’s 6-3 ruling overturning the Chevron Doctrine, but it does a succinct job at explaining what the Chevron Doctrine was and why it was under review.
The result of this Supreme Court ruling puts the interpretation of laws, statutes and regulations back into the hands of the courts rather than the hands of the agencies tasked with implementing and enforcing them.
For transportation, the implications are broad from the independent contractor business model and emission standards to electronic logging devices and demurrage and detention. In the short-term, there will be turbulence as these regulations are challenged, clarified and sorted out.
In the long term, there should be more stability at the regulatory level with agencies not dramatically changing course based on who is in the White House. Additionally, it will lead to clearer language and intent in the laws coming out of Congress.
