The Environmental Protection Agency (EPA) has opened the comment period for the California Air Resources Board’s (CARB) request for a waiver for their Advanced Clean Fleet (ACF) rule. A waiver is required because California wishes to establish emission guidelines more strict than the federal government’s.

CARB had planned to implement ACF January 1, 2024 but cannot do so without the EPA waiver. Nevertheless, CARB has stated they reserve the right to enforce retroactively. For drayage trucks, that means any new truck entered into drayage service beginning January 1, 2024 must be a zero emission vehicle (ZEV).

The emission guidelines and transition timelines established in ACF are neither practical nor achievable.

We encourage everyone to let your opinions and your voices be heard. The EPA will host a virtual listening session on August 14th. The session will be open to all interested parties. You can register for the session here. You may also submit written comments via their portal here. Written comments are due by September 16th.

Every comment must be read and responded to by the EPA, so it will likely take 9-12 months before a ruling is issued.
