Modern Worker Empowerment Act is a bill seeking to codify a clear and straightforward definition of Independent Contractor and provide certainty to truck drivers, gig workers and anyone choosing the independent lifestyle. Currently, the rules and definitions are subject to flip-flop with changes in administrations and at the US Department of Labor. Case in point, the current Biden-era rule is not being enforced while the Trump Administration reviews and changes.

English Language Proficiency (ELP): As required by the US Department of Transportation, the Federal Motor Carrier Safety Administration (FMSCA) provided guidance to law enforcement on how to enforce ELP. Starting June 25th, an inspector will conduct an ELP assessment including: 1) an interview to determine the driver’s ability to respond sufficiently in English, and 2) ability to read and interpret road signs, including dynamic roadside message signs. During the inspection, drivers are prohibited from using any form of translation assistance, including apps or cue cards.
